Terms and conditions

These terms form part of the package travel contract between Monster Trips OOD, UIC (EIK) 203369976, a tour operator holding licence No. РК-01-7387 and insured with ZK Lev Ins AD, called the OPERATOR below, and the person making the reservation, called the CUSTOMER. Ski Monster is the OPERATOR's trading name.

1.Reservation and booking

  1. A reservation for a trip is made through the reservation form on www.skimonster.bg, by phone or by email. The trip counts as confirmed by the OPERATOR once the CUSTOMER receives a confirmation, a contract and payment details.
  2. A contract for the package trip is concluded once a deposit of 50% of the confirmed trip price is paid.
  3. If the request and the confirmation differ, the OPERATOR sends a new proposal within 3 days. The agreed services are described in the offer provided and in the documents attached to the reservation.

2.Prices and discounts

  1. Prices on the site are given in euros and are paid in euros.
  2. Early-booking prices apply when the reservation is made, confirmed and a deposit of 50% of the total is paid within the period announced for each offer. If that period ends less than 45 days before the first service of the package, the full price is due.

3.Payment

  1. Within 3 days of the reservation being confirmed, the CUSTOMER pays a deposit of 50% of the trip price for the services described in the contract, unless stated otherwise.
  2. The balance is due 45 days before the date of the first service, unless stated otherwise.
  3. Payment can be made by bank transfer to the following account:
    1. a.Beneficiary Монстър Трипс ООД

    3. c.BIC UNCRBGSF
    4. d.УниКредит Булбанк АД
  4. Payment reference: the reservation number and the CUSTOMER's name.
  5. For bookings made less than 45 days ahead, the full amount is paid at the time of reservation. The same applies to changes and cancellation fees.
  6. Any extra charges the CUSTOMER owes in person at the resort (tourist taxes, local taxes, a security deposit and anything else expressly listed in the offer) are paid on site on arrival and check-in.

4.Documents for CUSTOMERS with Bulgarian citizenship

  1. A passport valid for at least 6 months after the trip date and medical insurance for the period of the trip.
  2. For EU countries with which Bulgaria has visa-free travel, an identity card is enough.
  3. For countries that require a visa from Bulgarian citizens, information is available from their consular services.
  4. Children under 18 travelling without one of their parents need a notarised parental permission (declaration) to leave the country.
  5. If the CUSTOMER does not present the declaration, or presents one filled in incorrectly, and is therefore not allowed to cross the Bulgarian border, the OPERATOR does not delay the programme for the rest of the group and owes the CUSTOMER no compensation for the missed trip.

5.Rights and obligations of the parties

  1. For travel outside Bulgaria the CUSTOMER provides the personal documents required, issued in line with the laws of the country visited and of the Republic of Bulgaria.
  2. The CUSTOMER pays the full price of the travel services described in the contract within the agreed deadlines.
  3. The CUSTOMER observes the law and customs of the country visited and leaves the countries included in the trip within the legally permitted time. Otherwise all consequences are theirs, and the OPERATOR is not responsible for the costs and formalities of their return to Bulgaria.
  4. If the CUSTOMER causes an incident or damage to hotels, vehicles or third parties, they compensate the established damage on the spot.
  5. A CUSTOMER who plans to travel to or stay in countries with a higher risk of infectious disease takes the preventive measures required by international medical standards.
  6. On organised group trips the CUSTOMER arrives on time at the meeting points set by the group leader. All costs the travellers incur through lateness or no-show and a missed bus, plane, ship, train or other transport are entirely theirs, whatever the reason for the delay.
  7. If the trip does not take place, the CUSTOMER returns the certificate of the insurance taken out.
  8. The OPERATOR provides the travel services paid for by the CUSTOMER and described above, in line with these terms and the contract.
  9. The OPERATOR provides the mandatory "Medical expenses for illness and accident" insurance for trips abroad (included in the package price or for an extra charge) and, at the CUSTOMER's request, insurance against other risks during the trip for an extra charge.
  10. For trips to countries that require a visa from Bulgarian citizens, the OPERATOR assists the CUSTOMER by providing the documents needed (reservations, voucher, tickets and so on).
  11. At the CUSTOMER's request the OPERATOR prepares and submits their documents to the consular services. In that case the CUSTOMER provides the OPERATOR with the documents the consulate requires and pays the visa fees.
  12. Failure to provide the documents, to pay the fees or to attend a consular interview where one is required counts as the CUSTOMER cancelling the trip through their own fault.
  13. Issuing a visa is solely at the discretion of the consulate concerned and is not guaranteed by the OPERATOR.
  14. If the consulate refuses the visa, the visa fees paid by the CUSTOMER are not refunded, and 51.13 euros of handling costs are retained, provided no other charge applies, such as a prepaid first night.
  15. If the OPERATOR significantly changes one of the essential terms of the contract, it informs the CUSTOMER immediately, and no later than 10 days before the start of the trip. The CUSTOMER informs the OPERATOR of their decision within 3 days of the notice, and no later than 7 days before the start of the trip.
    1. a.The "essential terms" of a package travel contract are: the price, the dates of departure and arrival, the length of stay, the route, the type of transport, and the location, type and category of the accommodation.
    2. b.Replacing the hotel, restaurant or entertainment venue with one of the same or a higher category or class is not a significant change to the contract.
  16. The CUSTOMER may:
    1. a.accept the changes, in a supplementary agreement to the contract that states their effect on the price;
    2. b.withdraw from the contract without paying a penalty or compensation.
  17. If the CUSTOMER withdraws under the previous clause, they may:
    1. a.accept another trip of the same or higher quality, where the OPERATOR can offer one, or
    2. b.accept a trip of lower quality, in which case the OPERATOR refunds the difference in price between the cancelled and the offered trip, or
    3. c.have the sums paid under the contract refunded within 7 days of the OPERATOR receiving the notice of withdrawal.

6.Changes to prices and services

  1. The OPERATOR may raise the price of the package trip up to 20 days before it starts, only because of:
    1. a.higher transport costs, including fuel;
    2. b.higher charges for services under the contract, such as airport, port and other fees;
    3. c.a change in the exchange rate relevant to the contract between its conclusion and the departure date.
  2. When the price changes:
    1. a.the increase must be economically justified and match the change in costs;
    2. b.an increase of more than 5% is a significant change to the contract;
    3. c.the price of the package trip may also go down.
  3. The OPERATOR may change the departure time and place and the arrival time.
  4. On organised group trips the OPERATOR may change the order in which the programme is carried out.

7.Changing a reservation

  1. Changes the CUSTOMER asks for after the reservation cost the same as a cancellation.
  2. For minor changes only a handling fee of 15 euros for the whole reservation is charged.
  3. Until 20 days before the first service the CUSTOMER may transfer their place to another person, provided the OPERATOR is told in advance.
  4. The transfer may be refused if the other person does not meet the requirements of the trip or if their participation would break the law. The CUSTOMER and the other person are jointly liable to the OPERATOR for the obligations under the contract.
  5. The other person signs a contract with the OPERATOR for the trip, and the original CUSTOMER's contract ends. Both are jointly liable to the OPERATOR for the total price and the costs of the transfer.
  6. The confirmed price of a flight ticket (in packages that include a flight) holds only if the ticket is issued at once. A change adds costs, paid separately, that depend on the airline's policy.
  7. The same applies to the whole price when flights are combined with ground transport.
  8. All changes to and cancellations of a reservation are made in writing.

8.Accommodation

  1. Hotels and buses are categorised by the authorities of the country concerned, not by the OPERATOR.
  2. The base price of each offer is for one traveller in a regular bed in a double room, unless stated otherwise.
  3. A single-room supplement or a discount for a child or a third bed applies only if the offer lists a price for it.
  4. A third bed (where available) is an extra bed, in most hotels a sofa bed, and suits children best.
  5. Children under 2 do not pay for hotel services and do not use them.

9.Flight tickets

  1. When a flight ticket is bought, the reservation is paid in full within 48 hours of confirmation.
  2. When a flight ticket is bought, the cancellation deadlines and penalties in the OPERATOR's terms do not apply.
  3. If the customer cancels after the ticket is issued, nothing is refunded, however long remains until the flight.
  4. Each ticket carries its own conditions of use and fees for changing the name, date, flight and so on.
  5. The CUSTOMER may take up to 5 kg of hand luggage and up to 20 kg of checked luggage, unless the ticket conditions say otherwise.
  6. Airport taxes are reconfirmed until the ticket is issued and may go up or down several times, for which the OPERATOR is not responsible. The OPERATOR informs the CUSTOMER of every change, and the CUSTOMER pays the difference.

10.Cancellations and penalties

  1. If the CUSTOMER does not pay within the set deadlines, and so acts in bad faith, the contract ends without any liability for the OPERATOR and without any refund of sums already paid.
  2. Payment is proven by a properly issued document (a till receipt or a payment order).
  3. If the CUSTOMER has paid a deposit but not the full price within the deadlines in the contract, the deposit is not refunded and the reservation is treated as cancelled.
  4. During organised group trips the OPERATOR may end the contract at once and stop the trip for an adult (18 or over) whose behaviour causes danger, distress, harm or anger, who commits criminal acts, or who causes serious trouble to other customers, the OPERATOR's staff or its partners.
  5. Such behaviour is recorded in a report signed by two witnesses. The OPERATOR is not responsible for how, or at what cost, that person returns to the starting point, including when the contract ends and the trip stops outside Bulgaria.
  6. On organised group trips the OPERATOR may cancel the trip if the minimum number of participants in the contract is not reached, or because of force majeure (war, terrorism, strikes, epidemics, natural disasters and the like).
  7. In those cases the OPERATOR is not liable for performing the contract and refunds all sums paid, less any non-refundable costs already incurred (non-refundable deposits, insurance paid, fees for returned tickets, visa fees and so on). Those costs are proven with proper documents.
  8. If the trip cannot run because too few people have booked, the OPERATOR informs the CUSTOMERS already booked, through the people who signed the contract, no later than 5 days before the trip starts.
  9. The OPERATOR is not liable to the CUSTOMER for cancellation, delay or changes to the dates and conditions of the reservation that do not depend on it, namely:
    1. a.cancellation or interruption of the trip for the CUSTOMER's personal reasons;
    2. b.the authorities refusing the CUSTOMER a visa;
    3. c.customs or border services not letting the CUSTOMER leave Bulgaria or enter the destination country because of missing documents or offences;
    4. d.other circumstances that amount to force majeure.
  10. The OPERATOR is not liable for failing to perform this contract, or performing it imperfectly, and owes no penalty, if this is caused by:
    1. a.the CUSTOMER, including not showing up at the set place and time of departure;
    2. b.a third party unconnected with the contract, in a way that could not be foreseen or avoided;
    3. c.force majeure or an event the OPERATOR and its partners could not foresee or avoid while acting in good faith. This includes delays at border crossings, difficult road conditions, strikes by airlines, ferry companies and others, checks of any kind at border crossings that take longer than planned, medical help for a member of the group, and other exceptional circumstances. In those cases the OPERATOR may change the programme and act as the situation requires, without owing a penalty.
  11. If the CUSTOMER cancels the trip and ends the contract, the OPERATOR refunds the price paid, retaining the cost of any issued flight ticket on flight packages, and also retains the following penalties:
    1. a.from the day after the contract is signed until 75 calendar days before departure: 50% of the package price;
    2. b.from 74 to 30 calendar days before departure: 100% of the deposit paid;
    3. c.from 29 to 14 calendar days before departure: 100% of the package price;
    4. d.for a reservation paid online by credit or debit card: 5% of the amount paid, whatever time remains before departure.
  12. Outside the cases above, if the OPERATOR cancels the trip and ends the contract, it refunds 100% of the price paid.
  13. By signing these terms as part of the package travel contract, the CUSTOMER confirms they know about the option of buying "Trip cancellation" insurance.

11.Complaints

  1. Complaints about the quality of the services paid for, including the conditions in specific hotels and hotel chains, are made by the CUSTOMER on site to the service provider and a representative of the OPERATOR, or to the local service company, so the problems can be fixed.
  2. If the parties are not satisfied, the complaint is made in writing within 14 days of the problem being found.
  3. The CUSTOMER gives the OPERATOR or the travel agent a written complaint (or a spoken one recorded in writing by their staff), the report of findings signed by a representative of the service provider or the local service company and by the CUSTOMER, a copy of the contract and a payment document (invoice).
  4. The OPERATOR replies in writing within 30 calendar days of receiving the complaint.

12.Termination of the contract

  1. Either party may ask to amend or end the contract because of a substantial change in the circumstances under which it was concluded.
  2. An agreement to amend, or a notice to end, the contract is made in writing.
  3. The party asking to amend or end the contract because of a substantial change in circumstances must prove that change.
  4. The OPERATOR may end the contract without notice, without owing penalties, a refund of sums already paid or the CUSTOMER's return to the starting point, if the CUSTOMER seriously breaches the contract because they:
    1. a.behave against the laws and customs of the country they are in at the time;
    2. b.behave in a way that threatens the safety or peace of the other participants;
    3. c.have not provided the required documents, and the authorities of the country stop their trip for that reason.
  5. When the contract ends, the parties' obligations end once all payments between them are settled.
  6. The CUSTOMER provides voluntarily all personal data needed to organise the trip, and the OPERATOR, as data controller, uses it only for the trip. Details are in the Privacy notice on www.skimonster.bg.
